Earthjustice Sues Trump Administration over the Exemption of the Endangered Species Act to greenlight oil and gas drilling in the Gulf of Mexico
Lawsuit Challenges Removal of Endangered Species Protections in the Gulf of Mexico
Four environmental groups have filed a federal lawsuit after the Trump administration granted offshore oil and gas drillers a broad exemption from the Endangered Species Act.
A coalition of environmental organizations is suing the Trump administration over a decision to eliminate Endangered Species Act (ESA) protections for wildlife in the Gulf of Mexico. The lawsuit, filed in the U.S. District Court for the District of Columbia, challenges what the groups call an unprecedented and unlawful use of a rarely-invoked federal provision.
The action stems from a vote by the Endangered Species Committee — sometimes called the "God Squad" — which was convened at the direction of Defense Secretary Pete Hegseth. Citing national security concerns, the committee granted a blanket exemption allowing offshore oil and gas operations to proceed without the standard species-protection review process required under the ESA.
Key facts
· The Endangered Species Committee has only convened 3 times since 1978
· This is the first exemption ever granted for an entire industry
· At least 20 threatened or endangered species may be affected
· Only around 51 Rice's whales remain in existence worldwide
The groups — Healthy Gulf, Turtle Island Restoration Network, Friends of the Earth, and Sierra Club, represented by Earthjustice — argue that no legal basis exists for the exemption. They note that no oil and gas permit has been denied solely due to ESA requirements, and that industry representatives have recently stated in federal court that current protections are not disrupting their operations.
Among the species potentially affected are Rice's whales, which live exclusively in the Gulf year-round, as well as several species of sea turtles, fish, rays, corals, and birds.

The case will be watched closely by conservation and legal advocates, as it may set a precedent for how national security exceptions under the ESA can be applied in the future. A federal court this week separately struck down a set of regulations from the first Trump administration that had weakened the law.
